UN Experts Call For A Review Of Hong Kong Security Law – Arrests Not Compatible With Human Rights And International Law

Four United Nations international rights experts have urged the Hong Kong authorities to launch an independent review of the Beijing-imposed national security law, saying it is “incompatible” with international standards of rights and civil liberties, according to a report by the Hong Kong Free Press on October 14th, 2021.

Such a move was triggered by the recent arrests of Hong Kong’s human rights activists including barrister Chow Hang-tung.

The HK government has rejected the accusation, saying that all decisions are based on evidence and free from inference. It also defends itself by saying that Hong Kong’s Basic Law guarantees rights under the ICCPR (International Covenant on Civil and Political Rights), but “such rights and freedoms are not absolute,” as ICCPR expressly states that the rights described in the document “may be subject to restrictions as prescribed by law that are necessary for protection of national security, public safety, public order or the rights and freedoms of others, and more.”

Beijing inserted the national security law directly into Hong Kong’s mini-constitution in June 2020, one year after the pro-democracy protests. It criminalized subversion, secession, collusion with foreign forces and terrorist acts. The law gave police sweeping new powers and has been used broadly to silence and punish dissidents in China.
